Once you have agreed (either orally or in writing) for Weichert (the firm we are associated with) and us to be your buyer's agent, we may not give any of your confidential information about you to sellers or their agents without permission. But until you make this agreement, you should avoid telling us anything you would not want a seller to know.
To make sure we have a clear understanding of what our relationship will be and what Weichert will do for you, you are encouraged to have a written agreement. We will be willing to represent and assist you for a time as a buyer's agent without a written agreement, but if you decide to make an offer to purchase a particular property, we must, by NC law, obtain a written agreement. Upon first contact, we will give you a brochure, "Working with Real Estate Agents," which fully explains agency relationships. Please be sure to read and understand it before signing the agency agreement.
As your Buyer's Agent, we represent you and owe you the following fiduciary duties:
Loyalty ... to put your interest above our own interests Care ... to use our skill and expertise to your benefit Disclosure ... to disclose all material facts relating to the transaction Accounting ... protect all money given or documents signed Confidentiality ... keep private information confidential
Compensation: Our compensation is generally paid by the seller's agent, under separate agreement. In the rare case where it is not, you will be informed of the full details before proceeding to view the property.
Disclosed Dual Agency:
This "dual agency relationship" will occur when you become interested in a property listed with us or Weichert. If you have not already agreed to a dual agency relationship in your (written or oral) buyer agency agreement, we will ask you to sign a separate agreement or document permitting this. Unless the property is listed by us, a separate Weichert agent will represent the other party. If it is one of our listings, we will represent the interests of both the buyer and the seller, during the same transaction. We will have responsibilities to both seller and buyer and must act in the best interests of both parties. We are prohibited from divulging confidential information to the other party.
